Driving Data and Privacy Policy

This policy outlines how driving data is collected, owned, and used when you use a device running openpilot from Spectacle. Please read this carefully, as it involves two separate entities collecting data: Spectacle and Comma.ai, Inc. ("comma").

1. Dual Data Collection Disclosure

The device you are using runs openpilot, an open-source driver assistance software developed by comma. Because the device is connected to comma's infrastructure via a cellular or Wi-Fi connection, driving data is collected simultaneously by both Spectacle and comma.

By using the device, you acknowledge and consent that your driving data will be collected, stored, and used by two independent parties under different terms:

  • Spectacle: We collect the data under the terms outlined in Section 2 and Section 3 below, which includes our strict commitment to anonymizing the data before any public release.
  • comma: comma independently collects the data under their own Terms of Service and Privacy Policy. We do not control comma's data practices.

2. Spectacle Data Ownership and Anonymization Commitment

In consideration for the use of the device, you assign to Spectacle all right, title, and interest in the driving data generated during your usage period. This data includes GPS routes, vehicle telemetry (such as speed, braking, and steering), and road-facing camera recordings.

We are committed to protecting your privacy. Spectacle explicitly agrees that before we publish, open-source, or share any of your driving data with third parties, we will fully anonymize it. Our anonymization process includes:

  • Removing or blurring GPS coordinates that could identify start and end locations (such as your home or workplace).
  • Scrubbing any personally identifiable information from the telemetry logs.
  • Ensuring no driver-facing camera footage is ever published or shared.

3. comma Data Ownership and Lack of Anonymization Commitment

You must be aware that comma's data collection is separate from ours, and they do not make the same anonymization commitments that we do.

According to comma's Privacy Policy, by using openpilot, you agree that comma owns all data conveyed to them by use of the service, and that they may use it or alter it in any way at their sole discretion. comma's data collection includes geolocation, trip durations, parking locations, braking, and acceleration.

Unlike Spectacle, comma's Privacy Policy does not contain any commitment to anonymize your data, blur your GPS routes, or restrict how they share or sell the data they collect. They state they may share information to develop new products or with business partners.

4. Your Privacy Rights

Depending on your jurisdiction, you may have statutory rights regarding your personal data.

  • Requests to Spectacle: You may contact us at [email protected] to request access to or deletion of the personal data we hold. However, once data has been anonymized and aggregated into our datasets, it can no longer be linked to you and cannot be deleted.
  • Requests to comma: Because comma collects data independently, any requests to access or delete data held by comma must be directed to them ([email protected]). Spectacle cannot delete data from comma's servers on your behalf.

By proceeding, you acknowledge that you have read this policy and consent to the dual collection of your driving data as described above.
