Device Usage Agreement
1. The Service
Spectacle provides the use of a comma four device running openpilot software, installed on your vehicle. The service covers the use of the hardware, the pre-installed software, and the associated connectivity required for the device to function. The service is available at $99 per month following a free trial period. Spectacle reserves the right to modify pricing with 30 days' notice.
2. Driver Assistance Device and Non-Self-Driving Disclaimer
THIS IS NOT A SELF-DRIVING SYSTEM.
The device and the openpilot software it runs provide driver assistance features, specifically Adaptive Cruise Control (ACC) and Lane Keeping Assist (LKAS). They are designed to assist a licensed driver, not replace one.
By using the device, you acknowledge and agree that:
- The device does not make your vehicle autonomous.
- You must remain attentive, keep your eyes on the road, and be prepared to take immediate manual control of the vehicle at any time.
- The software is provided "as is" and may experience failures, disengagements, or unexpected behavior.
- You are solely responsible for the safe operation of your vehicle and for obeying all traffic laws.
3. comma.ai Disclaimers and Terms
The openpilot software is developed by Comma.ai, Inc. ("comma"). Spectacle is an independent provider and is not affiliated with comma.
Your use of the device is also subject to comma's openpilot Terms and Conditions (available at comma.ai/terms). Spectacle makes no additional warranties regarding the performance, safety, or reliability of the openpilot software beyond what comma provides.
4. Liability and Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Spectacle, its officers, directors, and employees from any claims, damages, liabilities, or expenses (including attorneys' fees) arising from your use of the device, your operation of your vehicle while using the device, or any breach of this Agreement.
You accept full responsibility for any accidents, injuries, or property damage that occur while the device is in use. Spectacle shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the device.
5. Data Collection and Privacy
Your use of the device is subject to the Spectacle Driving Data and Privacy Policy. By agreeing to this Agreement, you explicitly consent to the dual collection of your driving data by both Spectacle and comma, as detailed in the Privacy Policy. You also agree to the assignment of data ownership to Spectacle in exchange for the use of the device.
6. Device Return
The device remains the property of Spectacle. If you choose to stop using the service, you must return the device and all included accessories (mounts, cables) in good working condition within 14 days. Failure to return the hardware, or returning damaged hardware, will result in a replacement fee.
By signing up, you confirm that you have read, understood, and agree to be bound by this Agreement.
